first draft of letter to lawyer

1. Christmas day. The minute orders do not state the times. The times agreed upon are from 6am to 6 pm. If they are not on the minute orders or i don't have some sort of legal paper stating this, he will not abide. (it has to be written orders) this is extremely important as the time is upon us. I have been calling your office for two weeks about this issue.
Why the minute don’t orders state what actually happened in court. You, I and he had agreed upon noon-6pm in the hall. On the first Sunday, he refused to meet me at noon, he said that we had to agree on a time and the time was going to be 10am. I tried to reason with him (just to amuse myself) but eventually told him i made arrangements to meet him at 10. XXXXX tells me i have to pay $35 to get a report from the court so we can "work this out" and it might not be by Christmas??

2. Child support. I am working and wish to pay my portion and my back portion. we need to make some deal with them for arrears and as i had previously mentioned, a) they did not adjust for the entire year i was on disability and only earning $800 b) they want $550 per month which is based on having no time with them. His household is a two income household. Douglas told you and i both in the hallway at the courthouse that he and Brenda had been living together for over a year. We need the new financial information and i want the past year adjusted. We also need to make sure that once this issue is handled, Douglas knows that he will not be receiving gas money from me in cash at the door anymore. (it has to be written orders)

3. i need an itemized bill. i have recently received a bill from you, however, have not seen the individual charges. Please send me this information. The balance i owe will be paid promptly.

4. Our divorce hearing was held on dec 10 2004. It was held as a mandatory settlement conference. i was in treatment at ucla at the time, called the court at the time of the hearing, spoke with the court clerk, faxed my doctors letter to her and she said she would call me back if there were any problems. She did not call. i had assumed the hearing would be postponed as the clerk and i spoke about. the hearing was held anyway and i did not get anything that I am legally entitled to. i.e. 1. Cobra insurance 2. i did not sign my rights away to half of his retirement. 3. alimony 4. i was ordered to pay half the debts on credit cards that were entirely in his name, used for internet pornography and 'stuff' he loaded into a uhaul truck out of our house. 5. they gave both legal and physical custody of the boys to him. 6. Neither party was supposed to enter into a domestic relationship until the date of nov 10, 2005. douglas told YOU in the hallway that he had been living with his new family for over a year. What happens about that? The only paperwork i have received was the "finalization of nov 10 2005" how is that possible? The rules of the court state that these kinds of orders cannot be made at a mandatory settlement conference. Yet it happened. And how can they completely disregard the letter from my doctor. What can i do?

5. My legal and physical custody has been taken away. i want it back. i want legal custody back especially since Douglas remains obstinate with me and refuses to discuss school issues, medical issues, and time sharing issues.

6. i need his cell phone number. i take four hour bus and train trips to meet those boys on Sunday mornings and in case a bus or train does not come, i need to be able to contact him. He travels an hour, maybe a little more to get to where we meet so it's possible he will not be at his house. He told me he would not wait five minutes for me.

7. He does not have the boys return my phone call. More importantly, on holidays!! This is not acceptable. He needs to see to it that the boys speak with their mother on ALL holidays. (it has to be written orders)
Douglas continues to badger the boys about their time with me. The boys tell me all sorts of lovely (not really lovely) things that he says about me. i recently learned that his girlfriend "hates me" i learned this through my seven year old. This has to stop. i want these boys in therapy by themselves so they have a neutral party they can speak their mind to. i want their sessions together. And i want them with XXXXX. They have been with her before. As soon as their father and i split up, i put them in therapy with her. They need to be there again. His insurance pays for it. He only has to pay a $10 co pay. He is emotionally abusing those children and someone needs to help them sort this chaos out.

Douglas sent me a harassing mailing. i spoke with XXXXX about it. However, there is no mention of harm. It’s a joke on the internet telling you that you can search for anyone's driver's license and when you put in the info it tells you it's searching millions of records then a license comes up with the name of the person you were searching for, a picture of a monkey, from the state of chaos. He mailed this from Hollywood, ca. He has no reason to be in Hollywood and it’s 10 miles from my house. i believe this man is dangerous and i have grounds for a restraining order, but i have no intention of doing that as i am trying to repair this relationship.
i plan to file my own declaration to the court detailing times, dates and events of incidents i have with Douglas.

So, the private tutor I hired will be there this Sunday.  It should be interesting.  Remember he requested her business card, that is because he knows I am hiring her from my work.  I didn’t want to give it to him; he has done all sorts of things with my personal information in the past.  But, I have a solution.  He wants info, so I will give him a copy of her transcripts and resume.  He is supposedly so concerned about his children; let’s see him complain about no business card.  He can have her phone number, I will allow him to meet her.  Besides, there is no better information then what I plan on giving him.  I can’t wait.

My dad went with me to see the boys and I told him that we would be glad to bring them home for him and here’s your twelve dollars. Asshole starts yelling that I am not obeying court orders because I took them across the parking lot from the mall to McDonald’s. Oh, no I said.

My dad tells him he needs to leave and he screams, “you don’t tell me what to do” as I’m walking away with the boys, he screams to me, “you’re gonna loose your visitation.” I turned my head towards him, smirked, and shook my head no.

Then, when he comes to pick them up, my dad asked dickhead if he could see the boys at some other point in the week (of course, you know the answer to that) that he would be here he tells him that he hasn’t called in over a year, dad says, you mean you haven’t returned my calls in over a year? And he just stands there two inches from dickheads face. Asshole says, I’m not getting into this and turns away. I was kinda praying dad wouldn’t punch him. But secretly wanted someone to. It won’t help, though.

Of couse, it’s Friday after thanksgiving and he has not made the boys available to talk to me in three days. It’s court ordered, prick, every night at 7 pm!! Follow the court orders! Man I wish we could make some agreements. It’s such childish bullshit.

It is funny! My x sent this to me. It’s a driver’s license. It has my name on it, a picture of a monkey and it’s the state of chaos. That’s funny.

Funny now, but this guy is crazy. I’m flattered that all he appears to do is think of me. That’s cool. No seriously, this guy is dangerous.

My father, who never worries about me because he “gives my safety to God” and that has obviously worked for me, is even worried. That worries me.

This guy isn’t shit. I can whip his ass and I cannot wait for the opportunity. I called a legal advocate lady I know at a domestic violence shelter. She asked me if the monkey was being hurt, if he had any bruises or bandages, if anything was threatening on it, which there isn’t, and she told me to keep it in a paper bag, plastic ruins finger prints, and if I get anything else at all like that from him, take it to the police. She also told me not to mention a word of it to him. Don’t let him know I have it.

This lady knows my x personally. She was a supervisor during that period of time. She once told me I deal with these types of men all the time. This asshole is going to get anything over on me. She was always encouraging me. Telling me I was doing great. She really helps women.

Anyways, I know that if it’s through the u.s. mail such as this was, it’s a federal offense and they will tell you to call the FBI. They have told me that before. I didn’t. Didn’t want to make a big deal out of it. And I don’t want to make a big deal out of this either. I’m not going to live in fear; I am not worried, but if this happens to anyone please be advised that this is dangerous behavior. Perhaps even psychotic. And Psychotic people are not predictable.

Anyway just more proof that if you happen to meet this asshole you need to run the other way!!

WTF!!

well mom wants to take the boys to the movies on sat and he said no the orders say you have to stay at the mall but in court it was suppossed to be ordered that we would specify somewhere in the victorvalley on those saturdays...so the minutes of the court don't reflect what we agreed on and my lawyers papers (order after hearing) was rejected by the court because it did not say what the minute order said, it said only what we agreed upon i don't understand after court when i told people what was suppossed to happen like noon and that thing some where in the VV mall. i don't understand. I dont understand how the court minute orders could not reflect what we said in court that makes no sense what is going on? and my divorce thing how they did that without me even with the letter from my doctor. it's so confusing. stupid demons trying to ruin me. whatever, it won't work.
